Terms of Service

The rules for using GolfDock as a golfer, course, league, admin, customer, or website visitor.

1. What these terms cover

These Terms apply to GolfDock’s mobile app, website, course dashboard, admin portal, course subscriptions, golfer subscriptions, leagues, events, onboarding, billing, and support. By using GolfDock or creating an account, you agree to these Terms. If you use GolfDock for a course, league, business, or organization, you also confirm that you have authority to act for that organization.

2. Accounts and responsibility

You are responsible for your account, your login credentials, and activity under your account. Course owners and league owners are responsible for the admins, scorekeepers, members, invitees, permissions, league settings, event rules, and course account activity they control. If you believe an account has been accessed without permission, contact us right away.

3. Golf safety and judgment

GolfDock gives scoring, GPS, course, league, and caddy-style information, but it does not replace your own judgment on the course. Distances, maps, course data, weather, wind, AI Caddy suggestions, and shot recommendations may be incomplete or inaccurate. You are responsible for safe play, course rules, local rules, pace of play, weather decisions, club selection, and where you hit the ball.

4. Subscriptions, trials, and billing

GolfDock offers free and paid plans. App subscriptions are purchased and managed through the applicable app store, such as Apple or Google. Course subscriptions, setup fees, and business billing may be processed through Stripe or another payment provider. Prices, billing periods, setup fees, minimum terms, renewal terms, taxes, and included features are shown at checkout, in the app store, or in a written order.

5. Automatic renewal and cancellation

Unless stated otherwise, paid subscriptions renew automatically until canceled. You authorize GolfDock and its payment providers to charge the payment method on file for recurring fees, setup fees, taxes, and authorized adjustments. App subscriptions must usually be canceled through the app store account used to subscribe. Course subscriptions may be canceled through the billing portal, admin billing tools, written order process, or support path made available to the customer. Monthly course plans may include a minimum commitment and early-buyout terms if shown at checkout or in a written order.

6. Refunds and failed payments

Refund treatment depends on the plan, app store rules, setup status, usage, and written order terms. Setup fees are non-refundable once implementation or onboarding work has started unless we agree otherwise in writing. We may suspend, restrict, or downgrade access for failed payments, chargebacks, fraud concerns, expired payment methods, or material breaches of these Terms.

7. Course accounts and onboarding

Course accounts may include setup, configuration, staff/admin invites, course data, leagues, events, reports, exports, billing tools, and support. The course is responsible for giving accurate information, selecting the right admins, getting any needed internal approvals, and making sure its use of GolfDock fits its own policies and obligations.

8. Leagues, events, dues, and prizes

GolfDock can help organize leagues, events, scoring, pairings, standings, communications, and related records. Unless we separately agree in writing, GolfDock does not hold player funds, guarantee league payouts, decide disputes for a league, or take responsibility for prize distribution, entry fees, side games, or local competition rules. League and course organizers are responsible for their own rules and communications.

9. Your content and data

You keep the rights you have in information you submit to GolfDock, such as profile details, photos, scores, messages, course requests, scorecards, and league or event data. You give GolfDock permission to host, process, display, transmit, and use that information as needed to provide, secure, support, and improve the service. You represent that you have the rights and permissions needed to submit the information you provide.

10. Course data and public information

GolfDock may use public sources, user submissions, course-provided materials, GPS data, maps, scorecards, and other references to build course profiles and course tools. Course data can change and may contain errors. Courses and users can report incorrect information to support@golfdock.app.

11. Acceptable use

Do not misuse GolfDock, interfere with the service, attempt unauthorized access, scrape or copy protected parts of the platform, reverse engineer protected software except where the law does not allow that restriction, upload unlawful or infringing material, harass other users, impersonate someone else, manipulate scores or billing, or use GolfDock to violate the law or the rights of others.

12. Third-party services

GolfDock relies on third-party services for things like hosting, maps, weather, payments, app store purchases, email, analytics, and infrastructure. Those services may have their own terms and privacy notices. We are not responsible for third-party services we do not control, but we choose providers we believe are appropriate for operating GolfDock.

13. Availability and changes

We work hard to keep GolfDock available, but we do not promise uninterrupted or error-free service. Features may change as the product improves, course needs change, laws change, or security requires it. We may suspend features, perform maintenance, or make emergency changes when reasonably necessary.

14. Intellectual property

GolfDock, including the software, website, app, design, brand, documentation, workflows, and platform materials, belongs to GolfDock and its licensors. Using the service does not transfer ownership to you. You may not copy, resell, or commercialize GolfDock except as allowed in a written agreement.

15. Beta and internal features

Some features may be limited to internal testing, super-admin access, invited testers, or future release groups. Beta or internal tools may change, break, or be removed. They should not be relied on as part of a paid plan unless they are expressly included in your plan or written order.

16. Disclaimers

To the fullest extent permitted by law, GolfDock is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing, usage, or trade practice. We do not guarantee that GolfDock will be uninterrupted, secure, error-free, or that course, GPS, weather, scoring, AI Caddy, or league information will always be accurate.

17. Limitation of liability

To the fullest extent permitted by law, GolfDock will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, personal injury, poor play, tournament outcomes, league disputes, or course-operation losses. To the fullest extent permitted by law, GolfDock’s total liability for any claim will not exceed the amount paid to GolfDock for the service giving rise to the claim during the 12 months before the event that caused the claim.

18. Indemnity

To the fullest extent permitted by law, you will defend, indemnify, and hold harmless GolfDock and its personnel from third-party claims arising from your misuse of the service, your submitted data, your league or course operations, your violation of law, your violation of someone else’s rights, or your breach of these Terms.

19. Ending access

You may stop using GolfDock at any time, subject to any active subscription, minimum term, app store, or written order terms. We may suspend or end access if needed to protect the service, comply with law, address nonpayment, investigate fraud or misuse, or respond to a material breach of these Terms.

20. Governing law and venue

These Terms are governed by the laws of Colorado, without regard to conflict-of-law rules, and by applicable federal law. Unless applicable law requires otherwise, disputes must be brought in the state courts located in Colorado or the federal courts serving Colorado, and each party consents to those courts.

21. Changes to these Terms

We may update these Terms as GolfDock grows, features change, or legal requirements change. The updated version becomes effective when posted, unless a later date is stated. Continued use of GolfDock after the effective date means you accept the updated Terms.
